This is very pivotal period for the politic in Thailand. The media reflect the opinions of Thai citizens about the rumor of tax evasion of SHIN Corporation. Most of Thai citizens feel uncomfortable and doubtful with the Prime Minister Taksin's legitimacy to run the office as the Chief Executive of Thailand after his family has entered an agreement to sell the stock shares to to Singaporean's business entity with the highest value since the security market of Thailand has begun in this country.
If he were a normal business man, there might be no any problem that will be worth talking about his family securities' deal with Singaporean company. However, he is the Prime Minister of Thailand, which his highest position in administration can facilitate him to gain the profit from his duties if he cannot distinguish the national interest and his own individual interest.
The SHIN Corporation security deal is enumerated as an infamous and an intriguing one because it renders SHINAWATRA family's assets increase appreciably from 40,000 millions baht to 73,000 millions baht in a short term.
His Excellency's family can gain the profit from the deal more than 73,000 millions baht, which is the highest value in Thai stock market history, after SHIN Corporation sells its shares to Singaporean company without paying any tax to the department of Treasury, around 2000 millions baht.
Even I, who used to whole-heartedly support his Excellency, am still curious about this business affair. I think it is not an exemplar for other Thai citizens in term of tax payer's point of view. Basically, it is believed that nobody wants to pay tax but it is not a good manner for the person like him who is in charge of the highest executive administration of the country.
I am not an expert in the taxation law, but I, in my good faith, am positive that everyone who gain the benefit from the resource of Thailand regardless how small amount of such resource, he or she should pay the tax without any exception.
In the current deal, a person who gains the capital gain from the security deal under the security exchange regulation will not be required to pay tax. Ironically, it is sad but true to say that most of all economic crises throughout the world have been aided and abetted by the professional lawyers who possess the expertise in taxation and accounting.
This fact caused me shamed to boast and enumerate myself as a lawyer because I have to share the same career with them.Most people hate lawyers because they are cunning and artful. They can render and change anything from black to white or wrong to right.
