Filibuster: Judge Alito's Confirmation As Supreme Court Judge

This period is very important for American Legal System. President Bush has nominated Federal Judge Alito as the new associate judge replaced to O'Connor who declared to resign from the office. The U.S. senate has conducted the hearing to consider whether Judge Alito is eligible for this highest honorable position for several week. Presently, some senators from Demorcrat party attempt to file the petition to contest Judge Alito confirmation as the Supreme Court Judge. They are positive that Judge Alito will disregard the discrimination action, especially, based on race and sex.

The Filibuster tactic, meaning that the senators or representatives will give the extremely long and unlimited speech to the senate or the congress to check the legislative action such as a legislative approval, will be applied to prevent the confirmation of senator. Here is an e-mail that John kerry tries to invoke the advocacy from the people through out the United State.

Yesterday, Senator Ted Kennedy and I told our colleagues that we supported a filibuster of Judge Alito's nomination for the Supreme Court. And we weren't alone. But the bottom line is that it takes more than two or three people to filibuster successfully. It's not "Mr. Smith Goes to Washington."

If you want to stop Judge Alito from becoming Justice Alito, use your own email list and organize. We can't just preach to our own choir. We need to prove to everyone - from our friends and neighbors to our fellow Senators - that the American people know Judge Alito will take our country in the wrong direction, and they expect something to be done about it.

So I'm asking you to join Senator Kennedy, me, and concerned citizens across America who are signing this petition to support a filibuster.

If Judge Alito gets on the Supreme Court, it will be an incredible mistake for America. And remember, this is one mistake that we can never take back.

I voted against Justice Roberts, but I feel even more strongly about Judge Alito. Why? Rather than live up to the promise of "equal justice under the law," he has consistently made it harder for the most disadvantaged Americans to have their day in court.

He routinely defers to excessive government power no matter how much government abuses that power. And, to this date, his only statement on record regarding a woman's right to privacy is that she doesn't have one.

There isn't a shred of doubt in my opposition to Judge Alito's nomination. I spent a lot of time over the last few years thinking about what kind of person deserves to sit on the highest court in the land, so I don't hesitate a minute in saying that Judge Alito is not that person. His entire legal career shows that, if confirmed, he will take America backward. People can say all they want that "elections have consequences."

Trust me, I understand. But that doesn't mean we have to stay silent about Judge Alito's nomination.

ขอเขียนภาคภาษาไทยครับ ...เผื่อมีเพื่อนสมาชิกคนไทยผ่านมา ...เรื่องนี้ ความจริง ผมได้เคยเล่าไปแล้วว่า ประธานศาลสูงสุด ของสหรัฐ ได้ตายไป และมีผู้พิพากษาท่านหนึ่งลาออกไป ทำให้ประธานาธิบดีบุช ส้มหล่น ได้เสนอชื่อบุคคลเข้าไปดำรงตำแหน่งผู้พิพากษาศาลสูงสุด ถึงสองท่าน ในยุคนี้ ซึ่งท่านแรก คือ Robert ไม่ค่อยมีปัญหาเท่าใดนัก แม้ท่านจะได้รับการแต่งตั้งให้เป้นประธานศาลสูงสุด โดยข้ามหัวผู้พิพากษาอาวุโส ที่เหลืออีก ๗ คนไปอย่างไม่เคยมีก่อน

นางไมเนอร์ ได้ถูกเสนอชื่อขึ้นแทนนางโอคอนเนอร์ แต่เนื่องจากนางไมเนอร์ ไม่ได้รับการยอมรับอย่างกว้างขวาง โดยมีการอ้างว่าเธอไม่เคยเป็นผู้พิพากษามาก่อนบ้าง ซึ่งความจริงไม่ใช่เหตุผลที่ดีนัก เพราะผู้พิพากษาศาลสูงหลายท่าน ไม่เคยเป็นผู้พิพากษามาก่อนเช่นกัน แต่สิ่งที่เป็นข้ออ้างอันโดดเด่น คือ ปรัชญาทางกฎหมายของเธอ ไม่ปรากฎแน่ชัดว่าเป็นอย่างไร เพราะเธอไม่เคยเขียนผลงานทางวิชาการ ไม่เคยแสดงจุดยืนในแนวคิดทางกฎหมายว่าเป็น Conservative หรือ Liberal เมื่อมีแรงเสียดทานอย่างมากมาย เธอจึงตัดสินใจประกาศสละสิทธิ์ ก่อนที่จะมีกระบวนการรับฟังความคิดเห็นและไต่สวนคุณสมบัติของเธอ

ประธานาธิบดีบุช ได้เสนอนาย Alito ขึ้นไป ซึ่งที่จริง ทั้งสามท่านที่ บุช เสนอชื่อ ล้วนแต่ความสัมพันธ์ส่วนตัวใกล้ชิดกับบุช ทั้งสิ้น แต่ดูเหมือนแนวคิดของ Alito จะไม่ต้องตาต้องใจฝ่ายพรรค Democrat อย่างมาก เพราะเขาเคยเสนอความเห็นและรับรองความเห็นการเลือกปฏิบัติต่อสตรี และชนกลุ่มน้อยไว้ เมื่อสัก ๒๐ ปีก่อนหน้านั้น บันทึกทั้งหลายแหล่ ได้ถูกงัดขึ้นมาพิจารณา หรือประจานกันต่อหน้าสาธารณะและมีการถ่ายทอดสดออกไปให้ประชาชนทั่วไปได้รับทราบอย่างกว้างขวาง นี่แหละนะ ที่ว่าคำพูด ก่อนพูด เราเป็นนายมัน หลังพูดมันเป็นนายเรา และจะคอยตามหลอกหลอนเราไปจนกว่าชีวิตเราจะหาไม่

วุฒิสมาชิก โดยเฉพาะฝ่ายพรรค Democrate หลายท่านจึงไม่อยากลงลงมติ และพยายาม ที่จะ Tactic ทางการเมือง ที่เรียกว่า Filibuster คือ การอภิปรายแบบไม่หยุด เพื่อป้องกันมิให้มีการลงมติได้ หากท่านผู้ใดเคยดูภาพยนต์ เรื่อง Mr. Smith Goes to Washington ซึ่งเป็นภาพยนต์ที่ดีมากเรื่องหนึ่ง เลยทีเดียว ก็จะเห็นเทคนิควิธีการนี้ โดยนายสมิธ ได้ใช้วิธีการนี้ เพราะสภากำลังลงมติ Impeachment เขา หลังจากที่ตนถูกกล่าวหาว่าทุจริต คอรัปชั่น โดยไม่เป็นความจริง แล้วเขาเลือกที่จะต่อสู้เพื่อป้องกันชื่อเสียงของเขา เขาจึงได้อภิปรายเป็นเวลาสองสามวัน จนเป็นลมคาห้องประชุม ...

Judge Alito อาจจะต้องประสบกับชะตากรรมนี้ คงต้องรอดูกันต่อไปว่า เส้นทางการเป็นผู้พิพากษาศาลสูงสุดของสหรัฐฯ ของเขานี้จะราบรื่นเพียงใด แต่แน่ ๆ คงไม่ได้โรยด้วยดอกกุหลาบแน่ ๆ ผมมองย้อนนึกถึงเหตุการณ์เมืองไทย รู้สึกว่าเส้นทางสู่การเป็น คณะกรรมการ ป.ป.ช. ก็ไม่ได้ราบรื่นเช่นกัน ทุกสิ่งทุกอย่างต้อง trade-off จริง ๆ เพราะกระบวนการยิ่งช้าเท่าไหร่ ผลเสียที่ไม่อาจจะคาดเห็นในปัจจุบันก็ยิ่งเกิดขึ้น ในขณะเดียวกัน หากกระบวนการดำเนินการเร็วเกินไป ความเสียหายในระยะยาวก็ยากที่จะเยียวยาเช่นกัน แต่ผมแค่สงสัยว่า เราจะต้องเสี่ยงหรือต้องเลือกทางสองแพร่งนั้นจริง ๆ หรือ เรามีทางเลือกอื่นอีกหรือไม่

เมื่อมองย้อนกลับไปถึงการเมืองไทยแล้ว

รู้สึกว่าทุกอย่างเป็นเพียงเกมส์แห่งอำนาจ

และผลประโยชน์เท่านั้นจริง ๆ

ผมยิ่งมองปัญหาต่าง ๆ ในเมืองไทยแล้ว

ผมรู้สึกปวดใจจริง ๆ

เมื่อไหร่หนอ ทุกอย่างจะดีขึ้นเสียที
