Facebook - Racial Discrimination!

The CNN news reports the events of white men party which engenders the racial discrimination problems. This story derived from the pictures posted in “Facebook.com” the popular sociality connecting site in the United States. These parties were called “the Gangsters,” which were arranged on Martin Luther King’s Day in several universities such as the Connecticut School of Law, university of North Carolina, and some universities in Texas.

On this site, it demonstrates the pictures of white men dressing and decorating in the same manner of African-American. Some of them tanned their skins completely dark like the black guys. Others had their hair cut like the so-called the “gangsters of black guys.”

These impersonating characteristics made the black student infuriated and called the White guys to apologize them. They said that this manner was totally inappropriate, particularly arranged on the National holiday of their African-American hero – Martin Luther King. His honorable hero did bravely fight for civil rights movement for them in the mid of nineteenth century. The white guys should have praise him. Even though the white guys have said that they had not intended to insult him or black guys, they should be aware of what they were doing!

In contrast, the white students spoke that they did not consider those parties were not inappropriate and shamed to insult any black guys. It was just a party. However, the organizers had not response for the opposite yet. Only did some arranging men say that they would like to apologize if such activities estranged the black’s feeling.

These events are salutary for us to remind ourselves about what we will do. Maybe, the face – and the term of losing face – in Asian country culture is very important for even the westerners!

Coolie Man!

Do you know that last two years the former Prime Minister of Thailand did speak the term "Coolie,"or "กุลี" in Thai, and it caused him a lot of problems to him? Most Thai scholars consider this term is too rude and uneducated because it contains bad connotation in itself. In contrast, I indeed do not feel anything about this word! I do not feel that it implies any bad definition!

Mr. Thasik Shinawatra said this term in the Labour Day on May 1, 20o5. By speaking the term of "Coolie," he was severely criticized that he aimed to insult any person who works in general tasks but gets the low income!

How do you think about this term? Is it a bad word?

To My Royal Police Cadet School!

A few month ago, after the notorious coup in September 19, 2006 which was wrongly called "bloodless one", the military regime set up the dictator cabinet to run Thailand during the coup period. This dictator cabinet induces popularism by asserting that they would implement the "King's sufficient economics ideal" and establish the "Happiness" for Thai, rather than the growth of GDP. How excellent is the dictator government's policy?
******************

I really like to know if the people have no any single penny, how can they have the so-called "happiness?" I am positive that they have to eat, unless they can smile to fulfill thier hungry feeling. If it can be true, it will be great! Ironically, it is impossible, particularly for me! I am only normal person.
******************

During this dictorship administration, the Prime Minister of Thailand appointed the Police Reform Committee to reinforce the ideal of transparency, efficiency and the free of corruption in Police Department.
******************
Numerous proposals have been declared and known to public. The most suspicious idea is to eliminate the Royal Police Cadet Academy of Thailand. Some members of this committee, such as Mr. Jarun Phakditanakul, the permanent secretary of Mistry of Justice, claim that my school engenders the bad police officer! Then, the change of police training institution is the best way to reform police misconduct! They submit that the current police training program at Police Academy is not good enough because it trains as the military alike!
******************
It might be true that the military training style is incongruent with the police job! However, it is bad logic to conclude that my school should be eliminated because the police performance is poor! The committee should realize that only a part of police force graduated from this school. Most of them graduated from several universities in Thailand including Chulalongkorn, and Thammasat University.
******************
Most of police misconduct in Thailand maybe derive from those police officers. Why does the committee not eliminate all universities in Thailand? I think the most important is that how to enhance the human resource in Royal Thai Police Department. The long chain of hierachical command is another crucial problem. The last one is the attitude of police officer; we have to take a long time to train them to better their attitude!
*****************
How can we trust the person who graduate from the universities mor than the persons who are trained for four years in police academy? According to my own experience, the pundits from universities have never been trained and implanted about moral either! Unlike the police cadet students, they have been morally implanted everyday!
******************
The social bonding and obligation in Thailand is very loose. Most Thai like to know police to get some "benefit" by paying some kickback or convenient fee. However, they blame other who get the privilege from the officials! When being subjected to poor-salary and unethically continuous education, some of those police officers take a bribe! It is so bad, but true. Under this condition, even the well-trained police officers cannot bear the tempting surroundings. How can the unimplanted-persons do? What the hell is Mr. Jaran's idea?

How much does it cost?

As mentioned in the last blog, I have been to St. Louis to celebrate New Year 2007.

We have been to the best Italian Restuarant in this city. It is very closed to the Little Italy in Down Town.

Everything is fine for me except I have never loved cheese. Since I came to the United States, I have rarely eaten American food. I cook my fovorite Thai food all the time.

We ordered a glass of fruit shake-up. Do you know how much?

It costed us almost $3 for each - six people, including tip. That means it is more than $15 for one glass!

Shit! How extremely prohibited is it?

St. Louis visiting

I have been to welcome the year of 2007 at Saint Louis, MO, for two nights and three days. You might be very surprised why I took so long time in this small town.

I indeed prefer to visit the historical place like the Gate way to Western territory. It fulfills me the needs to know about American history after President Jefferson bought this land from Napoleon.

At that time, this territory was unknown to any European countries and the United States.

Americans considered that the land purchasing of the fourth president was a stupid idea. The main goal of this project was to find the way to reach the ocean in the western coast. The President hired Lewis and Clark to explore this unknown land.

The disappeared for four years prior to coming back with the numerous reports of animals, rivers, etc. They finally were appointed the governors the new states! Unfortunately, one committed suicide!

I decided to go to celebrate the new year event this city because I like to learn about an American history. Additionally, I like to view the area around the Arch at the highest point of St. Louis city.

To do that, we have to pay around $10 for elavator to get into the highest of the Arch. It is around 600 feet high! From the summit point, I saw the old court house and others buildings showing in the fifth picture of this blog. On the other side of the Arch, I can see the liver and other sourounding buidings.

On the first day of my trip, I been to Washington University at Saint Louis. The first building I saw is so attractive that I cannot wait to taking a lot of pictures.

We been to many places during this trip. For example, we been to the Arch Gate way, Art Museum located in Forest Park.

We also went to the best Zoo in the United, and took around 3 hours to visit our old friends living in the Zoo!

We also have a chance to visit Thai Temple in St. Louis. It is coincidentally that the temple is very near to our hotel. We took only 10 minutes by car from our hotel to visit the monks.

We have no rice to share. Then, we donated some money to the temple instead. It is good time for us. The monk gave us the blessing and the charm!

We will visit this temple again if we have a chance!

Falling in Love and Having your hair cut?

Have you ever wondered why a person who has a new short hair cut would be asked whether s/he failed? Many Thai story films demonstrate such belief. For example, "Close-friend," which elucidates an intimate relationship between a couple - male and female - who has been studying in the same class for four years, witnesses this idea. While a man falls in love his close friend, but never let her know, she consideres him as solely a friend with whom she can share everything.
His love has been kept in his mind like a skelaton in the closset for several years! After finishing his final exam in the last year, he expresses to her that "I love you." She feels very surprised and she replies: "Why have you just told me at this time?" It implies that it might be too late to inform her because her soul is not empty.
A man walks from Chiangmai University to train station and ride a train to Bangkok, suddently. It might be the longest distance in his life that he has ever walked! When arriving at Bangkok, he has his hair cut as a new military man and takes a journey to the Southern part of Thailand. You can guess that where his soul is; correctly, it is still staying in Chiangmai. After getting an injure from an accident, he meets a nurse, namely Nui, who falls in love him instantly. Even though he still loves the former one, he decides to choose the latter whom he considers that she whole-heartedly dedicates herself to his life. I think it is the right call!
However, I still wonder why we have to have our hair cut after we are dissappointed with the love or hope. Do we want to change our own characteristics or outlook? Supposedly, I have been in the same boat with this man, I cannot percieve the point that I have to do likewise as the story mentioned above! Actually, love is all around the world. If you cannot complete your love mission with whoever, you should have learnt to love the new one.
Pertinently, you might have to learn to love youself! Don't let anyone be influent on your life! Love yourself!

Happy New Year 2007!

I have just come back from X'Mas celebration's 06-07 with my friends at UIUC. This new year is looming while my job needs to be done as soon as possible.

What my job is that I need to complete my dissertation about criminal procedure:

Comparative Confession Admissibility between Civil law and Common law countries.

I have completed my 5 chapters since August 06 till now. The four chapters are left for me to write.

I found that I need some free time to break my brain. I cannot pay utmost attention all the time to do it.

Last week, I have rarely done anything about it. My soul requires that "you need to take a rest."

I decided not to do anything seriously during last week. What I did was to review all chapters slowly, page by page. That is it!

I have been to Chicago for a few days! It has never dissappointed me! Chicago is the heaven where is always beautiful.

Those pictures I took by myself! I love them very much. Hope that whoever coincidentally coming across my blog will like it!

Happy New Year 2007!

The Pursuit of Happiness!

Yesterday, I have watched a movie namely something like pursuit of happiness. This movie narrates one’s human right to pursue what the ordinary human has never really got it. It is the happiness!
This movies instigates the ordinary persons like me to think “we should never give up, and we have to persue the happiness.” Indeed, nobody knows what the heck real happiness is. Each opens the road and follow one’s mind to reach it! When a normal person reaches what one has imagines that will be the last resource s/he yearns for, s/he feels that it is not what one’s wants! S/he, as a result, has never got it over and over.
One has to pursue the so-called “happiness” for whole the rest of life. Due to the internal fact that human has never know what really engenders her/his happiness, s/he will run around one’self to find out the new thing to complete the hole that s/he consideres imcomplete! But s/he might have never know what it is? Likewise, when we pursue someone we love, we like, or we just care, we might follow her/him without thinking the obstruction ahead.
However, when we got it, we might consider s/he is not good enough! It might be not because s/he is not as “good” as what we want in effect, but it is because our minds have never reached the acknowlegement what we want. It is indeed we have never know to stop luscious feeling, rather than the fact we assert!
Let pursue our hope and happiness! Hope that you guys can find out what you want and reach it. Hope more that you guys will learn how to stop pursuing when you haver already had!

What am I doing here?

Hey guys!

I just want to stop by my blog that even I myself have not visited somewhat ......long time. Do you know, I am very busy - reading and writing - everyday! It is my job to complete my dissertation. 7 days a week, I keep doing it! I confess, in deed, it is very boring but no alternative choice! What I can do is just trying to think positively that it is fun to read many books, articles and secure those beneficial ideas to formulate the" new one" on behalf of my own!

I accidentally figure out other dissertations that is fairly similar to me. He was a judge in Israel and a SJD student at NYU School of Law. He wrote his dissertation about the confession admissibility in major leading legal system, composing of the United States, United Kingdom, and others in civil law countries such as German and Russia! Even though he wrote it in 1972, it is still workable and very useful. Surprisingly, his ideas and mine are coindentally similar!

My dissertation is relating to the Confession Admissibility as well. In my proposal outline, the legal concepts of the United States, England, Canada will be enunciated to compare with other civil law countries, but I pick up some European countries such as Germany and France as well as some Asian Countries such as Korea and Japan. The rationale of my selection is that Thai legal system has been influence from Germany and France as well as those two common law countries - America and England. Korea and Japan as well as Thai are influenced by the religious ideal of Buddhism; those countries still share the idea of constitutionalism and "democracy."

Study those legal systems might be useful to reconsider about Thai legal system. In present era, Thailand sham to assert its legal concept as the most progressive especially in criminal procedure area of law. It prohibits using a confession statement obtained instantly after arrest as evidence ! Very interesting, right? While other countries around the world consider confession suddenly given to police after being arrested is reliable because s/he does not have time to think about lying or its defense. Confession in this instan is trustworthiness and should be the strongest evidence to prove the defendant's guilt! Thailand seeks to rule it out by the present Criminal Procedure Code under section 84 clause 4.

While England adopted the Act in 2003 to allow the court to use co-defendant's confession statement as evidence to convict the defendant in the same proceedings, Thailand cuts the judicial discretion to admit such confession as evidence. While English rule under the Act of 2005 entitles absolute powers to police to arrest and release the accused on bail at the crime scence, etc, Thailand seeks to eliminate all police power and has not provided any tool to beat the crime! What are the reasons behide the bar? Police misconducts in Thailand might contribute to this phenomon! But, you know! Police misconducts are the normal phenomena in other countries as well. Then, we might have to think what the best ways to deal with this problem are! We do not forget that innocent has the right too! Society has limited resources! And there are various values that conflict one another that we have to cope with in the best solution !

The, we might have to reconsider whether this new law (2004) is the best solution for Thailand! Many questions may ensue from this law as followings examples! Did the policy-maker think or be cautious about the victims' rights? Did they consider about the effectiveness of law enforcement officer to prevent the crime? Did they forget that they were in charge of the duties to protect the innocent people from the criminal who violated and destroyed the social order? Did they .....whatever should be to balance the individual suspect's rights and right of society to convict the wrongdoer who broke the social peace and other relating values? Did the criminal justice would be disreputed because the system let the wrong go free on the high social costs?

There are many questions should be concerned prior to making any policy. Deeply studying about the legal concepts, the potential undesirable outcome stemming form the policy, etc, should be conducted! Thailand may need more the sophisticated legal scholars and criminlogist to reconsider and integrated both pure science and applied knowledge to reconstruct the legal policy to reach policy to balance various values! Hope that my study will be part of those and useful in the future!

Please MY LORD BUDDHA blesses you guys and please entitles me the enlightenments

I HAVE A DREAM !

Last week, it was rumored that the Office of Prime Minister of Thailand appointed the Police Reform Committee; it made my heart so exalted that I could not explain anything.

For ever since, the Royal Thai Police (RTP) likes the ruined boat deriving from the widespread spoiled system in personnel administration, and abysmally long chain of hierarchy. Merely the relatives or close subordinates of high commander will be promoted to higher rank or position. Never does merit system in human resource management prevail in this crumple organization.

As a police officer who achieves in police career without commander’s auspice, I prefer the considerable change in RTP; since I was a junior police officer, I have shared my view points that one day, some time, the RTP would be better while my friends totally disagreed. I have never given up to my dream; when I acted as the head of legal affair audit division in Legal Affair Office in 2001-2003, my co-workers and I had never complied with any illegal order even though those derived from the highest commanders in RTP. I also survived as one of leading police officer whose career was progressive at the time.

I cannot put up with the bad system of RTP any more; what I can do since I have been studying Ph.D. in law in the United States is to write my article about the good police administration in Japan and in the United States. I am positive that the ideas I sell to the readers, of course some of them are senior police officers working in Thailand, will implant them and eventually they will concede the innovative idea to improve RTP in some day.

I hope that the Police Reform Committee will be able to develop my ruined both by shorten such fucking long chain of command, improving the poor system of “stick and carrot” which engenders the commonplace corruption in RTP, implanting ethical and professional police career, and establishing independent monitoring agency to promote good cops and punish bad cops, etc.

I would like to emphasize that “I have a dream!” that my RTP will be better! That is my a little bit happiness! Please make it true!

This note I exclusively would like to record the highest honorable herocic performance of one smallest person - a taxi driver, who sacrificed his life for a diminutive democracy ideal in Thailand.
Mr. Priwan, Noum-Tong, a-60-year-old man, committed suidcide on Nov 1, 2006 to defy the defy an contemptuous statement expressed deliriously by Col.Akara (พ.อ.อัคร ทิพย์โรจน์), a vice spokeman of "the Council of Democratic Reform."
In his letter, he indicated the cause of his suidcide commission, that is, he would like to reaffirm his democratic ideal and to challenge such an slovenly insane expression of the "Fake Council" that "nobody is so scrupulously honorable obsession in the democratic ideal that sacrifice his or her life for such believing."

To my honorable man, may your spirit rest in peace!

Thailand's Coup Discussion: Is the coup Justifiable for Thailand?

Thailand’s Coup d’etate Discussion: Is the Coup Justifiable?

Siriphon Kusonsinwut *

Abstract

This article is prepared for the discussion of Thailand coupe at College of Law, University of Illinois, under the auspice of Program in Asian Law, Politics and Society, on October 25, 2006.

The aim of this article is to illustrate that the claim of bloodless coup on September 19, 2006, is misleading and the excuses of the coup, such as commonplace corruption in democracy regime, are notoriously wicked. In fact, Coup d’tate, even though it is uniquely peaceful in Thailand,[1] is never necessary evil for Thailand. Merely the credulous and innocent people do believe such excuses. In contrast, the suspicious conducts of the elite elected by the citizens is actually necessary evil. Almost of all countries, which enshrine the democracy regime, subject to the same problems, including the corruption problem and the abuse of power initiating by the civilian government.

This roughly written article is composed of three parts: the basis of revolution and coup d’tate in Thailand, the bad excuse of the coup. The last one is conclusion, leading to the choice that Thailand must choose to do; going on Democracy or Dictator. However, don’t forget the statement: Power Corrupt, Absolute Power Corrupt Absolutely. No even single man will be eternally good without good system to check and balance the power.

Federal Rules of Criminal Procedure

1. Chief Police
2. Deputy Chief Police
3. แผนกมาตรฐานวิชาชีพตำรวจ ( Professional Standard Unit or Internal Affair

Crime against person unit
Crime against property unit
Juvenile Unit
Computer Crime Unit
Vice and Narcotic
Crime Science Investigation [23]
(Accident Investigation)

William Cohen, et al, 11 Constitutional Law: case and materials, New York: Foundation Press, 2001

[10] I am grateful to Professor Tom Dempsey, Director of Police Training Institute, University of Illinois, who grants me many invaluable materials about the Policing Management and Criminal Justice System in the United States of America.
Fifth and Sixth Amendment.
In United States v. Pollard, 959 F.2d 1011(1992)., the Court held that almost anything lawfully within the power of a prosecutor acting in good faith can be offered in exchange for a guilty plea.
The discretion of the prosecutor is very broad, and the Supreme Court is reluctant to intervene or review the discretion of prosecutor. Inmates of Attica Correctional Facility v. Rockefeller, the Court held that the prosecutors have the breadth of discretion in prosecuting discretion, and the judiciary may not compel the prosecution of a crime. Moreover, in Bordenkircher v. Hayes, 434 U.S.357 (1987)., the Court held that so long as the prosecutor has probable cause to believe that the accused committed and offense defined by statute, the decision whether or not to prosecute, and what charge to file or bring before a grand jury, generally rests entirely in his discretion.
However, a prosecutor’s discretion is subject to constitutional constraints. United States v. Batchelder. One of this constrains, imposed by the equal protection component of the Due Process Clause of the Fifth Amendment, is that the decision may not be based on an unjustifiable standard such as race, religion, or the other arbitrary classification. Furthermore, in Pepole v. Kail, The Court held that a state may not selectively enforce a municipal ordinance to achieve an unrelated government purpose.

[14] Powell v. Alabama, 287 U.S. 45 (1932), which the Court ruled that the necessity of counsel is vital and imperative to a sense of justice which no member of a free society would disregard. Moreover, in Brown v. Mississippi (1936), the Court ruled that “the torture chamber may not be substituted for the witness stand;” this case brought about the ending of the human brutality; and no confession from the torture can be used as the witness; any means which shock the conscience cannot pass the muster of the due process. In addition, in Rochin v. California, 342 U.S. 165 (1952), the Court ruled that the police cannot use the means to obtain the evidence by stomach pumping.
[15] Mapp v. Ohio, 367 U.S. 643 (1961), the Court provided meaning of the “Exclusionary Rule” conforming to the Fourth Amendment.
[16] Miranda v. Arizona, 384 U.S. 436 (1966), the Court defined the means that was consistent with the Fifth Amendment; the Court said that “ the restrains society must observe consistent with the Federal Constitution in the prosecuting individuals for crime “ no person shall be compelled in any criminal case to be a witness against himself.”
[17] Terry v. Ohio, 392 U.S. 1 (1968), the Court ruled about the police power to stop and frisk the suspect in the public place if they had some reasonable suspicion depending on the circumstances.
The United States, 222 F. 3d 1337 (2000) โดยศาลได้วางหลักการที่เป็น Authoritative judgment ว่า : “Defendant’s statutory interpretation was reasonable and entitled to deference. Defendant’s application of its regulation to the permapressing operation conducted on plaintiff’s imported articles was not incorrect. Defendant’s determination that the pants did not qualify for a partial exception from duty had to be sustained.”

Hitler and Thailand Coup: What the hell similar is?

I had a chance to watch a movie about Hitler history last week. It seems to me that it is very similar to the present phenomenon in Thailand. Hitler who worked for Military incredibly created the sentiment to all citizens in Germany after losing in the WWI, which in turn it imposed the duty on Germany to compensate damage to other countries.

He vividly depicted the ineffectiveness of democratic system at that period by identifying that the Germany citizens had been robbed by people from others based on the treaty clause demanding Germany to pay damage which might took around 50 years to complete the contract.

As a result, he would be able to persuade the people to terminate the treaty to compensate the damage resulting from the WWI, and entitled him an independent and absolute power to control both legislative and executive branch. Exactly, he corrupted such unconditional power and caused severe damage to his own country and innocent people.

Many columnists had been killed; Jew genocide, around 6 millions, occurred because of his hatred to this race. The WWII caused 60 millions people died after he procured absolute power in Germany. All of above factors, he got such power from the ability to stir sentiment of society and incited the flattery of hope and fear including abhorrence of different race of human!

Like Thailand, most people’s conducts depend heavily on the emotional and sentimental state of mind, especially, deriving from the "numerously suspicious conduct" of Former His Excellency Thasin, which still have been proven in the court of justice. For this reason; this feeling readily exposed to the military to easily demise and cease the democratic system.

The media also falsely identified that more than 80% of Thais concurred with the coup! Ironically, it is impossible for numerous reasons! I have never trusted in the "well-dictatorship" status of military government, as well as the civilian democratic government.

However, I am strongly positive that the civilian government deriving from democratic system is much better than other kinds of administration in terms of freedom of speech and possibility to scrutiny its performance.

In the United States, the state government will be examined by the citizens and the relating legal authorities both from Federal agency and state one. Most criminal commissions will be brought to criminally charge into court after the governor, such as in Illinois, had retired or resigned from office.

Consequently, I believe that it will be the same in Thailand if we learn how to substantiate the legal authority task and criminal justice system to carry out their jobs in the future. If we think that the former leaders and subordinates of civilian government corrupted, I am certainly positive that it will be much easier to bring them into justice than those ones who have been appointed by the military coup.

I merely wonder why we, Thais as a whole, do not want to learn how to walk before we can run! I am also afraid that the history I have watched in the movie will appear in Thailand!

Coup in Thailand!

Around 14 years of democracy in Thailand since 1991, it was destroyed by Chief Military of Thailand on September 19, 2006. Around 18:00 hrs, the coup d'tate seized power from civilian government while Prime Minister Thasin was attending United Nations in New York.

Ironically, some of people in Bangkok did nothing, but took pictures of tanks on streets. No one attempted to protest this unconstituional action of military. What happened to Thailand? In 1932, Thailand changed its administration from absolute monarchy to constitutional democracy with the king as the head of state. This country has been relentlessly subjected to the problems of corruption committed by politicians and government officials as well as the leader of coup.

The phenomena of coup d'tate is not abnormal in Thailand. Since 1932, there are 17 times of coup d'tate without violence. Interestingly enough, right? The facts that military which seized the power from civilian government including military regime, sometimes, sounds like the resolution for Thai society in a-more-than-60 year period of "Democratic regime" in Thailand.

Coup becomes the necessary evil for some of Thai people, but in deed not for me. Democracy needs time t0 develop itself and people in its society will gradually learn how to keep their rights as well as their duties. The coup by military is not the right resolution to deter or solve the problem of political problem in the long run. It might sound good at the inception, but in deed democratic mechanism is much better.

Historically, "necessary evil" has never become actually true! Evil is merely evil inherently, nothing else. Thailand subjected to evil circle at all the time as my following elaborated: Notorious corruption problems in politics -- Coup d'tate -- No protest; no violence; greeting by people who hate civilian government -- Attempt to continously dominate political mechanism by coup leader -- Publicly protesting by people -- Democracy plus anarchy -- Notorious corruption problems in politics again.

You will see what the next is! But how Thai people have never learnt about this historical evil circle? Are they too self-concern? Exactly, I guess, it is right! It sounds like none of better resolution for Thailand, but coup at the final means. No! I don't think so! What the heck why we won't let the people learn how to walk by themselves before they learn how to learn! As I have already mentioned, democracy needs times and resources; we might have to costly payoff for unethical politicians and other problems, but it is more sustainable than using other means!

To me, I don't believe in "Good Dictators." Or, you believe it?

OSAKA, NARA, and KYOTO !

I spent three days and four nights, from June 18 to 21, 2006 in other prefectures of Japan: Osaka; Nara; and Kyoto, which were and still are the one of most important city of Nippon. For this reason, I would like to narrate what I have seen to you. In my opinion, culture might the most important factor for all Japaneses to be good person, gentle man, and honest person. They are very proud of human dignity and cannot be blamed by other persons in communties!
On Sunday 18, waking up in early morning as usual, I caught the fastest train, namely Shingunzen, from Tokyo station to Shin Osaka, which let me arrive there in only 2 and a half hours more or less. You might acknowledge how fast is it if you remember how far and how long if you have to take a normal train from Bangkok to the zenith province of Thailand in merely a few hours.
I had been going to Osaka prefecture under an auspice of my Japanese friend, who is a prosecutor in Osaka Prosecutor Office. She is extremely generous enough to informally invite me to see her office and introduce me to meet her bosses, who are very high position in the Japanese Public Prosecutor Office.
Additionally, with the warm utmost hearted reception, I also have a chance to know the functions and the management system of this office. We, her bosses, co-workers, and I, had a wonderful lunch together in the 25th floor of this office building. You might know that Japanese is very strict in the class system or senior and junior system; they, however, treat me as one of their good friends. I found that all of prosecutors will be very careful about their life stlye; they will very be aware of contacting with other persons particularly the defendant's relatives. Their life style is very easy because they focus merely on their job. Working hard is not an extraordinory for them; most of Japanese public prosecutors will work from 09:00 hrs untill might night! They are extremly honorable; there is only one case of curruption since the Public Prosecutor office has been established. Maybe, the culture factor is the most important to instruct their life in this way.
After I have talked with those public prosecutor, I also have an opportunity to talk with senior police officer about the Japanese police system. It is very curious how to implant the brand new of police officer to be very honorable. The same as prosecutor, in Osaka, only one case of curruption committed by police officer appears in a-10- year period. They are relentlessly implanted about the self-esteem and strict on duties! Under this system, the police instructures will occupy the duty to teach their students in police school all over their lifes! To be honest is the most important that the police office have to enshrine. The salary system of Japanese police is very good! The police will get normal salary and the additonal money to compensate for its danger role of law enforcement officer. They also get good bonus if their performance is excellent! Every step of higher promotion in their duties, they will obtain traing both on job training and in college program.
Let talk about some interesting place in those three cities. During staying in Osaka, where Ms. Mika provided me a -6,000 yen - room per nigh as an accommodation, I spent a few days to visit the old capital cities of Japan like Nara and Kyoto as well as the modern city like OSAKA.
The first one, NARA, used to be the capital city during Nara period. Even a short time, around 75 years, Nara occupied numerous crucial places which saved from being destroyed during WWII based on the rich of culture and heritage of mankind, which thereby presently become the World heritage.
Unlike the latter one, the last one - OSAKA city - used to and still is the most important place for commercial activity and international affair of Japan. If you like the modern life such as "Universal city" as in the U.S.A, and the like, you might fine with this city. The same as in Shinjuku area which is one of the most popular sightseeing in Tokyo, you might find "Cabugi jo" or the place for sexual service in this city as well but the price is utterly prohipitted, around 50,000 yens or more for one night stand! If you really want to unfold Japanese girl's kimono, you might easily to obtain and satisfy with the fake sound of "I-TAI, I-TAI", which means "it is very painful but enjoyable, during your lustcious activity. Finally, you might subject to several problems because you cannot speak Japanese; consequently, you might be required to pay more and more for such affair! In short, I will not recommend you to get such service!
I have been the first place, NARA, by Japan Railway or JR train, around 650 yens from Osaka to Nara, which frankly I can say the train system is very confusing for all foreigners including me. It, nevertheless, is worth going there to see the the biggest Buddha statue in Japan which is located in this province. One day of wonderful walking around the old city which adopted the grid system, like the new city in the U.S.A., from Tang dynasty of ancient China to set this city is very great experience. I recommend you to come here and see those places by yourselves.
Before coming back to Tokyo, I intentionally stopped by Kyoto station, where I can easily travell around Kyoto city which is the longest and oldest capital city of Japan over 1000 years. Kyoto has occupied and boasted of innumberously stupendous crucial places for Japan history since in the ancient period until now. Over 1,400 temples and shrines are located in this privotal city. Those vital places are recognized as the World heritage which were not detroyed in the WWII due to its vitality. In that critical time, if the U.S.A. decided to destroy this city, where the Emperior occupied, the WWII would suddendly ended at the first automic bomb. However, the U.S.A. made the right call by saving this important place.
When you arrive for Kyoto, I suggest, you might find the information center in front of Kyoto station, and buy a one day ticket, approximately 500 yens, to take a bus in the loop of sightseeing place around this city. This service is very confortable for you to plan and use it by looking into the number of the bus and time schedule as well as the places intriguing to you. The buses are really on time. Kyoto city provides 20 bus lines for its own citizens and everyday innumerous tourists.
Unlike Tokyo, in this city, it might be much better to travell around by taking bus service, rather than taking subway or other type of transpotation service. One of several interesting places is the temple which “Ikkyo-san” , the most intelligent little monk, belonged to when he was yong and spent his life in the religious service. You might not know that the term of "Ikkyo-san" or “ อิคคิว ซัง,” means “let’s me take a rest for a while even though you might get used to such term during an interlude song demonstrating in such cartoon.
In this temple, one of several buildings, at the center of the pond, is covered by “gold,” which is very brilliant. Please do not ask me if it is real gold because I have no idea about it. Umm, I maybe cannot tell you everything I have seen for one day trip in this wonderful city; you should come to discover those yourselves.
Lastly, I would like to say that Shingunzen is also good experience for you to try. It sounds that the price is somewhat high, or "Takai" in Japanese, but very convenient, and I am positive that it is much more comfortable than taking an airplane. You have to pay two kinds of fee; (1) ticket fee and (2) service fee. For example, I have to pay around 7,500 yens from the ticket fee and around 5,500 yens for service fee in order to get Shingunzen. That means I have to spend around 27,000 yens for round trip between Tokyo and Osaka.
Comparatively, it is is cheaper than taking an airplane and much more convenient to boot. During on train, you can walk around the train and you get food service as well as other facilities on such train. However, you have to be very careful about the Japanese habit; please be quiet and turn your cell phone to the silent mode.

Try it whenever you have a chance to come to Japan.

Wonderful Life in Tokyo!

Like a miracle event, I have a chance to spend my life in Tokyo, Japan from May 24 to July 2, 2006.
While studying in Master Degree of Public Administration at Thammasat University Thailand, I had been implanted about the Japanese Model of Business Management and Public Affair. It was, and still is, extremely impressive to me about Japanese's ideas."Without existing of company, without employees and the vise ver sa."
Most Japanese will be willing to work hard for their companies not only the highest benefit of such entities, but for the good common of them - both company and employees as the unique family. For this reason, if the entities subject to the dilemma; those employees will do everything that renders the company exists and thereby they will not be defunct from the market. Simultaneously, the entities will treat their employees as a member of family; no lay off policy can be adopted in the homogeneous society of Nippon.
Tremendously astonishing components of Japan make me utterly doubtful. Most scholars illuminate that the people in this country have never been tolerate with the different ideas; they think and believe in the same way; the cultural factors control their behaviors since they were born until they pass away. Homogeneous society, then, has been imposed on the characteristics of people of Nippon. Then, the new generations must act in the same way as their forerunners. Social control is the strongly powerful effect to the people's habits.
I found that everywhere I visited is very neat and clean even in the fresh market and public road. No has been discarded even single trash on the road while I cannot see anything prepared for the people to disposed their garbage. It sounds wonderful for me because everyone has to carry their rubbish wastes to home and keep the public clean.
I can compare this different behavior with the general people in the United States where I have been living for three years. All public places must be equipped with several kinds of garbage bins that can save humungous amount of those disposal ones in public places. If there is none, it might be beyond our imaginary view of point about those wastes!
I came here in May 24, 2006 on the special support of East Asian Pacific Study Center at the University of Illinois At Urbana-Champaign, namely Pre-dissertation summer traveling program. My first intention is to study about Japanese Criminal Justice System, specifically, the confession admissibility and community policing policy. Those particular topics are relating to my doctoral degree thesis at College of Law University of Illinois.
In my view point, it is very intriguing to study why the clearance rate of crime in Japan is unbelievable high or said differently the highest one in the World.Maybe the close relationship between law enforcement officer and the society might be one of several factors that push this homogeneous people being in this way.
If the culture factors of this country are not too severely incongruent with that of my country, introducing the Japanese Model might enrich Thailand's achievement in crime clearance rate and thereby renders our society neat and peaceful.
Ministry of Justice arranges me a schedule to visit him and the Office of Prosecutor on June 12, 2006; they will provide documents and instructions of Japanese Criminal Justice System as a whole. I might have a chance to interview the prosecutors who inquire the crime investigation and also talk with some judges to find out what I want.
On June 14, 2006, National Police Agency of Japan provides me the visiting of this office and the Tokyo Metropolitan police office to see their activities. I thought it might be very useful for me to learn how the police act to the people and what factors that cause the police and people have the best relationship which finally corporate one another to achieve the crime clearance rate.
From June 18 to 22, 2006, I will visit the Osaka prefecture to talk with Judges, prosecutors and police office in this area. Mika, a Japanese prosecutor and friend of mine, will act as my interpreter during my visiting. I hope that this visiting will provide me a huge benefit as my intention.
Because of Osaka location which is very close to Kyoto and Nara, I plan to visit those cities as well after I have finished officially discussing with my law enforcement officer career. Those are the former capital city of Japan in the ancient period. I believe it must be my best opportunity through out my life because I can obtain my academic knowledge and concomitantly I can visit those vitally historical places.
Finally, I have an appointment to speak with Professor Kawakami at University of Waseda University on June 29, 2006. After talking with the officers who work in the practical world, I will have a room of window to talk with one of eminent professor in criminal law area of Japan to see how those ideas might be incongruent with each other and how they repair those incompatibilities. An approximately one month must be most valuable time in my life. Learning culture and practice in reality as well as an academic idea are the goal of my plan.
Thank you very much Professor Tom Ginsburg and Professor Thomas Ulen who always support me and fund me for this visiting!

"I really Love Illinois! Thank you very much for supporting me!"
